Terms and conditions of use
Le presenti condizioni (di seguito “Condizioni di Utilizzo”) disciplinano i termini e le condizioni di accesso ed utilizzo delle piattaforme/portali Fiorentini (di seguito “Portale“) e si applicano a ogni utilizzo, oltre che al suo contenuto, alle informazioni, alle raccomandazioni e/o ai servizi forniti da Pietro Fiorentini S.p.A. (di seguito “Venditore”) al cliente (di seguito “Cliente”) all’interno del sito.
L’accesso e l’utilizzo di Portale è subordinato all’accettazione delle presenti Condizioni di Utilizzo.
Credenziali di accesso e autenticazione
L’accesso a Portale è consentito solo previa autenticazione del Cliente mediante le credenziali di accesso. L’accesso può avvenire tramite utenza Microsoft, nel caso il Cliente ne sia in possesso. Altrimenti, per il Cliente è possibile impostare una propria password d’accesso. Il Cliente si obbliga a custodire, conservare, utilizzare e mantenere segrete, con la massima cura e diligenza, le Credenziali di Accesso che sono strettamente personali e non possono essere cedute e/o divulgate a terzi non autorizzati.
In fase di autorizzazione all’accesso a Portale, il Venditore registrerà a sistema nome, cognome, e-mail (fornita in fase di registrazione dal Cliente), cliente di riferimento.
Il Venditore si riserva la facoltà di sospendere e/o interrompere, a sua insindacabile discrezione e senza obbligo di preavviso, l’utilizzo di Portale da parte del Cliente, compreso, a titolo esemplificativo, in situazioni in cui il Venditore ritenga che l’utilizzo delle piattaforme/portali stia violando una delle Condizioni Generali di Utilizzo e/o configuri una violazione di legge o in caso di risoluzione del contratto di vendita o di distribuzione sottostante.
Tutela della proprietà intellettuale
Le piattaforme/portali di Pietro Fiorentini e tutto il contenuto, inclusi, a titolo esemplificativo ma non esaustivo, loghi, icone, marchi, testo, grafiche, fotografie, immagini, immagini in movimento, audio, illustrazioni, informazioni tecniche e commerciali e software (di seguito “Contenuto Portale”), sono e rimangono di proprietà esclusiva del Venditore. Il Cliente è autorizzato a vedere, riprodurre, stampare e scaricare documenti o altri materiali, anche audio e video, presenti in Portale solo per uso personale, informativo e non commerciale. In ogni caso, al Cliente non è permesso modificare, copiare, distribuire, trasmettere, riprodurre, pubblicare, concedere in licenza, derivare altre applicazioni, trasferire o vendere il Contenuto Portale.
Riservatezza e Confidenzialità
Il Cliente riconosce che tutte le informazioni di cui verrà a conoscenza durante l’utilizzo di Portale ed il Contenuto Portale hanno natura confidenziale e riservata e si impegna per sé e per i propri collaboratori e dipendenti a non utilizzarli e divulgarli a terzi, in qualunque modo e con qualunque mezzo.
Esclusione di garanzie
Il Venditore non garantisce che il Contenuto Portale sia privo di errori né che i prodotti offerti siano disponibili in maniera continuativa. Il Venditore non fornisce alcuna dichiarazione né garanzia riguardante l’utilizzo del Contenuto in termini di correttezza, accuratezza, adeguatezza, utilità, puntualità, affidabilità o altro.
È esclusa la responsabilità del Venditore qualora, per errore imputabile ad una scelta errata del Cliente, i beni acquistati dal Cliente tramite Portale siano inidonei all’uso a cui sono destinati.

Legge applicabile e foro competente
Le Condizioni di Utilizzo sono regolate dalla legge italiana. Tutte le controversie derivanti dalle presenti Condizioni di Utilizzo saranno risolte mediante arbitrato secondo il Regolamento della Camera Arbitrale della C.C.I.A.A. di Milano, da un arbitro unico, nominato in conformità a tale Regolamento. Sede dell’arbitrato: Milano.
Protezione dei dati del Cliente ex DLgs. 30.6.2003 n. 196 s.m.i. e al Regolamento UE 679/2016.
Tutti i dati del Cliente acquisiti ai fini della registrazione a Portale o in occasione del suo utilizzo da parte del Cliente saranno trattati e conservati dal Venditore su carta, archivio elettronico o supporto magnetico e verranno utilizzati al solo scopo per cui sono stati raccolti.
These terms and conditions (hereinafter “Terms and Conditions of Use”) govern the terms and conditions for access to and use of the Fiorentini platforms/portals (hereinafter “Portal”) and shall apply to all uses, as well as to its content, the information, the recommendations and/or the services provided by Pietro Fiorentini S.p.A. (hereinafter “Seller”) to the customer (hereinafter “Customer”) inside the website.
Access to and use of Portal shall be subject to acceptance of these Terms and Conditions of Use.
Access credentials and authentication
Access to the Portal shall be allowed only following authentication of the Customer by use of the access credentials. Access may be granted through a Microsoft account, if the Customer has one. Otherwise, the Customer may set their own access password. The Customer undertakes to safeguard, store, use and preserve the confidentiality, with maximum care and diligence, of the Access Credentials, which are strictly personal and may not be made available and/or disclosed to unauthorised third parties.
During authorisation for access to the Portal, the Seller will register in the system the name, surname, e-mail (provided during the Customer’s registration), customer of reference.
The Seller reserves the right to suspend and/or interrupt, at its sole discretion and without any obligation to provide advance warning, use of the Portal by the Customer, including but not limited to, in situations where the Seller believes that the use of the platforms/portals violates one of the General Terms and Conditions of Use and/or constitutes a violation of the law or in case of termination of the underlying sale or distribution contract.
Protection of intellectual property
The Pietro Fiorentini platforms/portals and all their content, including but not limited to, logos, icons, brands, text, graphics, photographs, images, moving images, audio, illustrations, technical and commercial information, and software (hereinafter “Portal Content”), are and shall remain the exclusive property of the Seller. The Customer shall be authorised to view, reproduce, print and download documents or other materials, including audio and video, present in the Portal exclusively for personal use, for information and not for commercial use. In any case, the Customer may not modify, copy, distribute, send, reproduce, publish, license, use for the creation of other applications, transfer or sell the Portal Content.
Non-disclosure and Confidentiality
The Customer acknowledges that all information of which they will become aware during use of the Portal and the Portal Content is confidential and reserved and undertakes to ensure that they and their associates and employees do not use it and disclose it to third parties, in any way and by any means.
Disclaimer of guarantees
The Seller does not guarantee that the Portal Content is free of errors nor that the products offered are continuously available. The Seller does not make any statements nor does it provide any guarantee with regard to the use of the Content in terms of correctness, accuracy, appropriateness, usefulness, precision, reliability or other.
The Seller shall not be liable if, due to an error attributable to a wrong choice by the Customer, the goods purchased by the Customer through the Portal are unsuitable for their intended use.

Applicable law and jurisdiction
The Terms and Conditions of Use are governed by Italian law. All disputes resulting from these Terms and Conditions of Use shall be settled through arbitration pursuant to the Regulations of the Arbitration Chamber of the Milan C.C.I.A.A. [Chamber of Commerce, Industry, Crafts and Agriculture], by a single arbitrator, appointed in compliance with said Regulations. Seat of arbitration: Milan.
Protection of the Customer’s data pursuant to (It.) Legislative Decree no. 196 of 30.6.2003 (as amended) and Regulation (EU) 679/2016.
All data of the Customer acquired for registration to the Portal or when it is used by the Customer will be processed and stored by the Seller on paper, electronic files or magnetic media and will be used exclusively for the purpose for which they were collected.
